Mediation Services
Canadian lawyer, mediator and arbitrator, Murray H. Miskin, who has over 40 years of civil litigation trial practice experience, provides mediation services in construction, estate, insurance, franchise, banking, personal injury and other civil disputes on a regular basis. He also mediates complex condominium disputes applying his experience as a condominium resident and Condominium Board President. It really helps to have a mediator who has both the generic skills in mediation plus legal knowledge and the specialized experience of the subject of the dispute for mediation. Most of Murray’s career as a lawyer has been focussed on personal injury matters but now he is mostly working on Estates and Estate Planning. He has more trial experience than most “Trial Lawyers”. During Covid, Murray Miskin has been using Zoom for online mediation. Online mediation has proven to be more economical and very effective. It will continue to be a popular way of mediating in the future well beyond the Covid-19 pandemic. Murray is doing in person mediation as well as online mediation. Our Mediation/Arbitration facility and law firm branch office is in the Oshawa Executive Centre and we hold mediations there with no facility charge.
Murray Miskin has been an active arbitrator since 1987. In February 1997 Murray took comprehensive Mediation training at Osgoode Hall Law School and began to do work as a Mediator mostly with personal injury cases. He went on to take advanced mediation training from Christopher Moore of Boulder, Colorado. He was in high demand on the Toronto Superior Court Roster of Mediators which he joined in 1999. He left the Toronto Court Roster in 2003, when the demand for his mediation services became too high to the point where it interfered with the law practice. As a lawyer Murray Miskin began to represent individual claimants nationally in class actions and asbestos compensation claims since 2003. The Miskin law firm has, in the past few years, gone from solo practice to a national personal injury law firm with the addition of experienced insurance lawyer Chris Goddard handling accident claims, and Murray’s son Daniel Miskin, who was called to the Bar in Ontario in June 2019, and works primarily in class actions and asbestos cancer compensation. Murray Miskin continues to manage the firm and Conflict Resolution activities such as mediation and arbitration have been given top priority in scheduling his time, with flexibility in dates. This allows for mediation to be arranged where requested without a long wait for available dates. Murray has shifted his law practice to do more estate planning and administration with some estate litigation, but a preference for estate dispute resolution work.
Most of Murray Miskin’s work as a lawyer has been in the field of insurance law where he began his legal career with the Phelan, O’Brien firm in Toronto in 1979 as an articling student and then one year as a lawyer working with Brendan O’Brien and L. Paul Shannon. He worked as junior to Edward M. Futerman from 1982 to 1985 before leaving Toronto to have his own practice based in Whitby, Ontario. Miskin Law moved its main office to Peterborough Ontario in 2012. Murray Miskin served as Chair of the Insurance Law Section of the Ontario Bar Association from 2000 to 2001 and the National Insurance Law Section of the Canadian Bar Association from 2003 to 2004. Murray Miskin is ideally suited to provide insurance mediation services. He is recognized for his expertise in personal injury claims, which he mediates on a regular basis. More recently Murray has had much experience with Estate disputes which he also mediates. Murray will travel as needed for mediation including international travel. Murray has provided confidential mediation services in the Caribbean, on retainer from the Government of the Turks and Caicos Islands.
Murray Miskin offers hourly, half-day and full day rates for Mediation Services and does not charge for travel in the Greater Toronto area. He mediates online using Zoom and from the Miskin Law Office and ADR Facility in the Oshawa Executive Centre. Work done outside of Southern Ontario and internationally will ordinarily be billed for reasonable travel time and expense. Murray also has provided mediation training in places as far away as Nunavut. He has special expertise in the Med/Arb process and much of his mediation teaching has been focused on that. If you are looking for a highly skilled experienced lawyer to mediate a case, you sometimes have to book up to a year ahead. Murray Miskin has organized his schedule in a way that still keeps most of his time open for day to day work on the law practice. That work has time flexibility so that mediations can be booked on short and medium term notice to accommodate the parties and their lawyers.
